Terms of Use

Welcome to VELSAYA. These Terms of Use ("Terms" or "Agreement") govern your access to and use of VELSAYA, including VELSAYA.com and the features, services, content, communications, communities, and tools made available through the platform (collectively, the "Service").

By accessing, browsing, registering for, or otherwise using VELSAYA, you agree to be legally bound by these Terms. If you do not agree to these Terms, you must not access or use VELSAYA.

1. VELSAYA Is an Adult-Only Community

VELSAYA is intended exclusively for adults. You must be at least eighteen (18) years old, or the minimum legal age required in your jurisdiction to access adult-oriented material, whichever age is greater.

By accessing or using VELSAYA, you represent and warrant that you meet the applicable minimum age requirement; are legally permitted to view adult-oriented or sexually explicit material in your jurisdiction; are not violating any applicable law, statute, regulation, ordinance, or other legal requirement; and are accessing VELSAYA voluntarily and by your own informed choice.

You understand that VELSAYA may contain mature, adult-oriented, sexually suggestive, or sexually explicit content. If adult content is illegal or prohibited in your location, you may not access VELSAYA.

VELSAYA does not permit minors to register for, access, participate in, or be depicted in adult areas of the Service.

2. The VELSAYA Service

VELSAYA is a social and community platform that allows Members to create profiles, communicate with other Members, publish content, participate in communities, and use other features made available by VELSAYA.

Features may include member profiles, blogs, photos and galleries, media sharing, classified advertisements, private messaging, Clubs and private communities, member subscriptions, Network and reputation features, community moderation, booking and scheduling features, VELSAYA Points, and other social, communication, discovery, or premium features.

Features may be added, removed, restricted, redesigned, or modified at any time. Except for content specifically identified as being created by VELSAYA, content appearing on the Service may be created and controlled by individual Members.

3. Acceptance of These Terms

These Terms apply to all users of VELSAYA, including registered Members and anyone otherwise permitted to access any portion of the Service. You may use VELSAYA only if you agree to comply with these Terms and all applicable laws.

Your continued use of VELSAYA constitutes your ongoing acceptance of these Terms. VELSAYA may revise these Terms from time to time. Updated Terms become effective when posted unless otherwise stated. If a material change is made, VELSAYA may provide additional notice where appropriate.

4. Member Accounts

Certain VELSAYA features require registration. You agree to provide accurate information when creating and maintaining your account.

You are responsible for maintaining the confidentiality of your password, protecting access to your account, all activity occurring through your account, and promptly notifying VELSAYA if you believe your account has been accessed without authorization.

You may not access another Member's account without authorization, share or transfer your account in a manner prohibited by VELSAYA, impersonate another individual or entity, or misrepresent your identity in a manner intended to deceive, defraud, threaten, or harm another person.

VELSAYA may require email verification, age declarations, quarantine or introductory review periods, or other account-verification procedures.

5. User-Generated Content

VELSAYA allows Members to create, upload, publish, transmit, send, or otherwise make available content, including text, messages, blogs, comments, classified advertisements, photographs, videos, profile information, links, reviews, ratings, and other materials ("User Content").

You are solely responsible for the User Content you submit. VELSAYA does not endorse User Content merely because it appears on the Service and does not guarantee that User Content is accurate, truthful, complete, safe, lawful, or reliable.

6. Ownership of Your Content

VELSAYA does not claim ownership of the original User Content you create. You retain your ownership rights in your User Content.

By posting or uploading User Content to VELSAYA, you grant VELSAYA a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, transmit, resize, compress, format, process, and otherwise use that User Content as reasonably necessary to operate the Service, display your content to authorized users, provide features you choose to use, and deliver, secure, moderate, maintain, and improve VELSAYA.

This license continues for as long as the applicable User Content remains stored by VELSAYA, subject to reasonable backup, archival, legal, and technical retention requirements.

7. Your Rights to Content You Post

By submitting User Content, you represent and warrant that you own the User Content or have all permissions necessary to post it; the content does not violate another person's copyright, trademark, privacy, publicity, contractual, intellectual-property, or other legal rights; the content does not violate these Terms; and your posting of the content is lawful.

You are responsible for royalties, license fees, permissions, or other obligations associated with content you submit. Do not upload content that you do not have the right to use.

8. Zero Tolerance for Content Involving Minors

VELSAYA is an adults-only platform. You may not upload, publish, transmit, link to, request, solicit, distribute, or otherwise make available sexual or adult-oriented content depicting or involving any person under eighteen (18) years of age.

This prohibition includes photographs, videos, illustrations, drawings, cartoons, animation, AI-generated imagery, computer-generated imagery, or other visual representations.

You may also not intentionally depict an adult as a minor in sexualized content through clothing, makeup, poses, props, descriptions, roleplay, presentation, or similar means.

Content that VELSAYA reasonably believes violates this rule may be removed immediately. An account associated with such material may be immediately suspended or terminated and may be reported to appropriate authorities where required or appropriate.

9. Prohibited Conduct

You may not use VELSAYA to engage in unlawful, abusive, fraudulent, dangerous, or prohibited activity. Prohibited conduct includes, without limitation:

• Harassment, stalking, intimidation, or credible threats.
• Fraud, scams, or intentional deception for financial gain.
• Impersonation intended to deceive or harm another person.
• Posting another person's private or identifying information without authorization.
• Copyright or intellectual-property infringement.
• Promoting illegal goods or services or facilitating illegal activity.
• Attempting to bypass account restrictions, security systems, moderation decisions, or access controls.
• Malicious interference with VELSAYA's systems or other Members.
• Uploading malware, malicious scripts, or other harmful code.
• Using another Member's reputation or Network rating as leverage, coercion, retaliation, or extortion.
• Manipulating, buying, trading, coercing, or retaliating through ratings, reports, votes, reputation systems, or other trust features.
• Falsely reporting another Member in bad faith.

10. Member Interactions

You are solely responsible for your interactions with other Members. VELSAYA does not independently verify every statement, identity, profile, photograph, representation, rating, advertisement, or claim made by Members.

You should use appropriate judgment when communicating with or meeting another Member. VELSAYA does not guarantee that any Member is who they claim to be.

VELSAYA is not a party to private relationships, arrangements, transactions, agreements, meetings, or disputes between Members unless expressly stated otherwise. VELSAYA reserves the right, but has no obligation, to become involved in disputes between Members.

11. Network, Reputation, and Community Trust Features

VELSAYA may provide Network ratings, reputation information, community trust tools, reviews, or similar Member-generated signals. These features represent Member-submitted opinions and experiences and are not guarantees by VELSAYA regarding the identity, character, reliability, safety, integrity, or conduct of any Member.

Members submitting ratings must do so honestly and based upon their own experience. Rating manipulation, retaliatory ratings, reputation extortion, rating trades, coercion, intentionally false ratings, or reckless endorsements may result in restrictions or termination.

VELSAYA may use algorithms, weighting systems, Member history, confidence indicators, account levels, and other factors in calculating reputation or community trust information. Such formulas may change over time.

12. Reporting Content and Members

VELSAYA may provide reporting tools allowing Members to report profiles, blogs, comments, photographs, galleries, classifieds, Clubs, messages, or other content. Submitting a report does not guarantee that content or an account will be removed.

VELSAYA may review reports and determine what action, if any, is appropriate. Knowingly false, retaliatory, malicious, or abusive reports may themselves violate these Terms.

13. Community and Staff Moderation

VELSAYA may use a combination of community reports, community voting, reputation-weighted review, automated systems, moderators, administrators, and other trust and safety procedures to review Members and content.

Depending upon the circumstances, moderation may result in content removal, warnings, restricted features, silence or communication restrictions, quarantine, temporary suspension, permanent account termination, or other appropriate action.

Where community moderation features are available, you acknowledge that eligible Members may participate in decisions concerning content or account restrictions. VELSAYA reserves final authority over the operation and enforcement of its Service.

14. Content Removal

VELSAYA may refuse, restrict, hide, disable, or remove User Content if VELSAYA reasonably determines that the content violates these Terms or applicable law, infringes another person's rights, creates a safety or security concern, constitutes spam, fraud, or abuse, interferes with operation of the Service, or otherwise creates a legitimate platform-integrity concern.

VELSAYA is not required to monitor all User Content before publication. The existence of moderation tools does not create an obligation for VELSAYA to discover every violation.

15. Account Restriction or Termination

VELSAYA may deny, restrict, suspend, quarantine, or terminate access to all or part of the Service where VELSAYA reasonably determines that you violated these Terms; your account creates a safety or security concern; your account is being used fraudulently; you repeatedly abuse Members or platform systems; you attempt to manipulate moderation or reputation systems; continued access creates legal or operational risk; or action is otherwise permitted or required by law.

Serious violations may result in immediate suspension or termination without advance notice.

16. VELSAYA Points and Paid Features

VELSAYA may offer virtual credits known as VELSAYA Points. Points may be purchased, earned, granted, transferred where permitted, or otherwise obtained through features offered by VELSAYA.

Points may be used for premium or enhanced services, classified enhancements, gallery access, premium account features, booking-related services, Club features, media or storage-related features, and other services designated by VELSAYA.

VELSAYA Points are a virtual platform feature and are not legal tender, bank deposits, cryptocurrency, or cash accounts.

Except where required by applicable law, Points have no cash value outside VELSAYA, are not redeemable for cash, purchases of Points are final, Points used on a feature later removed because of a violation are not refundable, and termination of an account for violating these Terms does not entitle the Member to reimbursement for unused Points or previously purchased features.

17. Classified Advertisements

Classified advertisements are created by Members. VELSAYA does not guarantee the accuracy, legitimacy, safety, legality, condition, availability, or quality of anything described in a classified advertisement.

Unless expressly stated otherwise, VELSAYA is not a party to any transaction, meeting, agreement, arrangement, purchase, sale, or exchange resulting from a classified advertisement. Members are responsible for conducting their own due diligence.

18. Clubs and Private Content

VELSAYA may permit Members to create Clubs, restricted galleries, subscriber-only content, private content, or other limited-access spaces.

An access restriction limits who may view content through normal VELSAYA functionality. It does not guarantee that another Member will never copy, photograph, record, reproduce, disclose, or otherwise misuse content after viewing it.

Members should not upload anything they are unwilling to risk being copied or disclosed by another person. VELSAYA cannot guarantee the conduct of Members who are granted access to restricted content.

19. Third-Party Links and Services

VELSAYA may contain links to third-party websites, products, advertisements, applications, or services. VELSAYA does not control those third parties and is not responsible for their content, accuracy, security, privacy practices, availability, goods or services, policies, or conduct.

A link appearing on VELSAYA does not necessarily mean that VELSAYA endorses the linked service. You access third-party services at your own risk.

20. Intellectual Property of Others

VELSAYA respects intellectual-property rights. You may not upload, post, transmit, reproduce, or distribute material that infringes another person's copyright, trademark, patent, trade secret, or other proprietary rights.

VELSAYA may remove allegedly infringing content and may restrict or terminate accounts belonging to repeat infringers.

21. VELSAYA Intellectual Property

Except for User Content, VELSAYA and its operators retain all rights in the Service and its original software, design, branding, logos, graphics, interfaces, features, databases, text, technology, and other proprietary materials.

Nothing in these Terms transfers ownership of VELSAYA intellectual property to you. You may not copy, reproduce, modify, sell, sublicense, reverse engineer, commercially exploit, or redistribute VELSAYA proprietary material except as expressly permitted by law or written authorization.

22. Privacy

Your use of VELSAYA is also subject to the VELSAYA Privacy Policy. You are responsible for deciding what information you disclose publicly or privately to other Members. Do not assume that information voluntarily shared with another Member will remain confidential.

23. Service Availability

VELSAYA is provided on an "AS IS" and "AS AVAILABLE" basis. VELSAYA does not guarantee that the Service will always be available, uninterrupted, secure, error-free, or free from technical problems.

VELSAYA may experience maintenance, software errors, hardware failures, network interruptions, hosting outages, data transmission problems, third-party service failures, security incidents, or other technical issues. VELSAYA may modify, suspend, discontinue, replace, or restrict features at any time.

24. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELSAYA DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES REGARDING THE SERVICE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, SECURITY, OR AVAILABILITY.

VELSAYA DOES NOT WARRANT OR GUARANTEE THE CONDUCT OF ANY MEMBER, THE ACCURACY OF MEMBER CONTENT, THE IDENTITY OF ANY MEMBER, THE SUCCESS OF ANY RELATIONSHIP, TRANSACTION, MEETING, BOOKING, OR INTERACTION, OR ANY PARTICULAR RESULT FROM USING VELSAYA. YOUR USE OF VELSAYA IS AT YOUR OWN RISK.

25. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELSAYA AND ITS OWNERS, OPERATORS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE VELSAYA.

THIS INCLUDES, WITHOUT LIMITATION, DAMAGES ARISING FROM MEMBER CONDUCT, USER CONTENT, LOSS OF DATA, LOST PROFITS, LOST OPPORTUNITIES, PERSONAL INTERACTIONS, THIRD-PARTY SERVICES, UNAUTHORIZED ACCESS, OR SERVICE INTERRUPTIONS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VELSAYA'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID DIRECTLY TO VELSAYA DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LEGALLY BE EXCLUDED UNDER APPLICABLE LAW.

26. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless VELSAYA and its owners, operators, affiliates, officers, agents, contractors, partners, and employees from claims, damages, losses, liabilities, expenses, and reasonable attorneys' fees arising from or related to your use of VELSAYA, your User Content, your violation of these Terms, your violation of applicable law, your infringement of another person's rights, or your interactions, agreements, or disputes with another Member.

27. No Responsibility for Member Conduct

VELSAYA is not responsible for the online or offline conduct of any Member. To the maximum extent permitted by law, VELSAYA assumes no responsibility for injury, loss, damage, dispute, fraud, harassment, misconduct, or other harm resulting from interactions between Members.

VELSAYA may provide reporting, moderation, reputation, or safety tools, but those tools cannot eliminate all risk.

28. Changes to or Discontinuation of the Service

VELSAYA may modify, replace, suspend, restrict, or discontinue any portion of the Service. VELSAYA does not guarantee that any particular feature will remain available permanently. Where reasonably practical, VELSAYA may provide notice of significant changes.

29. Governing Law

These Terms and any dispute arising from or relating to VELSAYA shall be governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

To the extent legally permitted, you agree that disputes arising from or relating to these Terms or the Service will be brought in an appropriate state or federal court located in California.

30. Jury Trial Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND VELSAYA KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN CONNECTION WITH A CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.

31. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed where necessary. The remaining provisions will continue in full force and effect.

32. No Waiver

VELSAYA's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.

33. Entire Agreement

These Terms, together with the VELSAYA Privacy Policy and any additional policies or terms expressly incorporated into them, constitute the agreement between you and VELSAYA regarding your use of the Service. Section headings are provided only for convenience and do not affect interpretation.
